Arguments people use for not paying income tax.

1st Amendment - This is the whole, “I’m going to create my own religion and be tax exempt.” business.  Internal Revenue Code makes an exemption for religious institutions, in the form of special tax codes and deductions.  It does not make an exception though.  you still have to pay taxes.

5th Amendment - The Takings Clause, which I stated in the Brushaber v. Union Pacific Railroad case, doesn’t free you from taxes.  Nor does the self incrimination part.  United States v. Sulliivan took care of that.

5th Amendment arguments have a long storied case history of being pwned by the courts and dismissed.

13th Amendment - Yes, the amendment that abolished slavery.  People argued that being forced to pay income tax, amounted to involuntary servitude, which was declared unconstitutional by the 13th Amendment.  This argument has been declared a “legally frivolous federal tax return position” and is subject to a $5000 fine.

14th Amendment - Also, one of the post-Civil War amendments.  The 14th defines citizenship, and says all citizens of the US are subject to Federal law.  Anti-tax people argue that this amendment was not ratified properly, because of the ante-bellum status of the governments of the secessionist Southern states.  They claim those state governments did not reflect the will of the people, and that anythin they ratified was not in line with the people’s (slave owning Confederates) will.

Those are the biggies, my book goes on and on, but I’m getting tired.

The income tax is Constitutional.

All joking aside, the tax laws need to be simplified and re-written.  This has been said time and time again into perpetuity.  Maybe straight percentage of tax is the way to go instead of having such a complex set of incomprehensible rules that everybody loathes dealing with on a yearly basis.

Of course, the rich people who use the rules to evade paying large amounts of taxes they should be paying aren’t going to be happy with this, so I don’t see the idea taking off any time soon.

I believe in following the law of the land. Some people might have heard of it… called Constitution. I don’t want to pay income tax because it’s unconstitutional. I want Federal Bank/IRS abolished… because it’s unconstitutional. I don’t want federal government to decide whether abortion or gay marriage should be legal or not. That should vary from state to state by the people who live there. I don’t want to be FORCED to take care of the homeless guy down the street. I’ll help out if i want to.

I want government to promote fair competition, liberty, and freedom. I want government to protect this country (this does not mean going overseas and meddling in their business). I want government to provide people with best environment where they can succeed. It’s not about pre-determined size of the government but more about following the rule of the land. If they followed the rule, size of the government would take care of itself.

Is that asking too much?

i think it is asking a lot to have the irs and federal bank abolished.  i’m not a huge fan of income taxes either, but how would you fund the federal government?  should property and sales taxes be increased?

i think i understand where you’re coming from on not wanting to have the feds decide on social issues and regulating businesses.  my fear is that with out regulations is that it becomes like the wild west where there is nobody watching out.  we would be watching out for whatever we care about only.  but there is a lot more than we ourselves can keep an eye on.  i imagine monopolies would be a lot more common place and businesses could get more cut throat.  consumers would also likely be hurt because they couldn’t trust businesses to be good.  would you ever put money in a bank if you didn’t know how well they were doing and if they went under you could lose everything?

my point is, i think to have such a large country, we need a large government.  there are huge projects that i think only the government could make go (although it might run at a loss).  something like a national transportation system, rail or highway isn’t something a private company would ever really want to do, unless they made it unaffordable.  it would suck to have private toll roads all over the place.  i think the environment would also suffer with less government.  we already see companies mess up the earth when there is the epa, imagine if they didn’t have to worry about anybody looking at what they do?

Apparently size and helmet shape were really important to Korean nationalists.
